Terms of Use for SkyCompanion

The mobile application ETANA SkyCompanion (“App”) is published and operated by ETANA SYSTEMS GmbH, Sophienstr. 40, 38118 Braunschweig, Germany (“we”, “us”, “our”). It is created to provide drone operators with informational and educational data to support the operation of drones and post-flight documentation, e.g. weather data, airspace traffic, and NOTAMs.

These Terms of Use apply to any and all:

  • uses of the ETANA SkyCompanion,
  • forms, materials, consent tools, comments and all other content or contributions available in the ETANA SkyCompanion,
  • forms, materials, consent tools, comments, posts, and all other content which you contribute to the ETANA SkyCompanion.

We reserve the right to change these Terms of Use at any time. The changes will come into force upon publication in the App.

1. Quality and Availability of Information

We assume no liability or responsibility for the topicality, correctness, completeness or quality of the information provided in the App ETANA SkyCompanion. The App cannot and does not contain any legal, aeronautical or meteorological advice. Any information in the App is provided for general informational and educational purposes only and is not a substitute for professional advice. There may be information in the App that contains typographical errors, inaccuracies or omissions, including descriptions, pricing, availability and various other information. We reserve the right to correct any errors, inaccuracies or omissions and to change or update the information in the App at any time, without prior notice.

Any information provided in the App might not be available at any time due to technical or any other reason. The service of this app relies on various third-party data and service providers. The availability and functionality of the App is subject to the availability and proper functioning of these third-party services. We have no direct control over these third-party services and cannot guarantee their continuous availability or performance. Accordingly, before taking any actions based upon such information, we encourage you to consult with the appropriate professionals. We do not provide any kind of legal, aeronautical or meteorological advice.

The service of this app provides value through its proprietary interpretation, categorization, analysis, extractions and presentation of information. Users acknowledge that the underlying data is sourced from third-party providers and public sources. The subscription fees and API charges are for accessing our enhanced processing, interpretation, and delivery of this information, not for the raw data itself.

2. Limitation of Liability

The mobile application is provided on an as-is and as-available basis. THE USE OR RELIANCE OF ANY INFORMATION CONTAINED IN THE MOBILE APPLICATION IS SOLELY AT YOUR OWN RISK. To the fullest extent permitted by law, we disclaim any and all warranties, expressed or implied, in connection with the App and your use thereof. In no event, we or our directors, employees or agents will be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special or punitive damages arising from the use of the mobile application, even if we have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us during the one (1) month period prior to any cause of action arising.

3. Third Parties and External Links

The mobile application ETANA SkyCompanion may contain (or you may be sent through the mobile application) links to other websites or content belonging to or originating from third parties or links to websites and features in banners or other advertising. Such external links are not investigated, monitored, or checked for accuracy, adequacy, validity, reliability, availability or completeness by us. We do not warrant, endorse, guarantee or assume responsibility for the accuracy, completeness or reliability of any information, product or service offered or advertised by third party websites linked through the App or any website or feature linked in any banner or other advertising. We assume no liability or responsibility for any bugs, viruses, Trojan Horses or the like which may be transmitted through the App by any third party. We assume no liability or responsibility for privacy practices of any third party. We will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgement and exercise caution where appropriate.

4. Use of the Application

If you use the mobile application ETANA SkyCompanion you warrant that you will agree and comply with these Terms of Use and with all applicable laws. You also acknowledge that you may not:

  • Systematically retrieve data or any content from the App to create or compile, directly or indirectly, a collection, compilation, database, or directory.
  • Use the App as part of any effort to compete with us or provide, or otherwise make available, the its services to any third party.
  • Delete the copyright or other proprietary rights notice from any content.
  • Modify, copy, decipher, decompile, disassemble, reverse engineer, redistribute, publish any of the software, its source code or algorithms comprising or in any way making up a part of the App.
  • Attempt to bypass any measures of the App designed to prevent or restrict access to the App, or any portion of it.
  • Interfere with, disrupt or create an undue burden on the App or the networks or the services connected.
  • Use, launch, develop or distribute any automated system that accesses the App, or uses or launches any unauthorized script or other software in the App.
  • Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses or any other material, including excessive use of capital letters and spamming, that interferes with any party’s uninterrupted use and enjoyment of the App or modifies or interferes in any way with the functions, operation or maintenance of this app.
  • Upload or transmit (or attempt to upload or to transmit) any material that acts as an information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies or any other similar devices.
  • Circumvent, disable, or otherwise interfere with security-related features of the App, including features that prevent or restrict the use or copying of any content or enforce limitations on the use of the App and/or its content contained therein.
  • Make any unauthorized use of the App, including collecting usernames and/or email addresses of users by electronic or other means for any purpose.
  • Engage in any automated use of the App, such as using scripts to send comments or messages or using any data mining, bots or similar data gathering and extraction tools.
  • Use the App in a manner inconsistent with any applicable laws or regulations.
  • Trick, defraud or mislead us and other users, especially in any attempt to learn sensitive account information.
  • Attempt to impersonate another user or person or use the username of another user or create user accounts by automated means or under false pretenses.
  • Make improper use of the App, including our support services or submit false reports of abuse or misconduct.
  • Use any information obtained from the App in order to harass, abuse, annoy, intimidate, threaten or otherwise harm another person, including our employees or agents.
  • Disparage, tarnish or otherwise harm, in our opinion, us and/or our products and services.
  • Engage in unauthorized framing of or linking to the App.
  • Sell or otherwise transfer your user profile or account.

The consequences for violating these Terms of Use or our Legal Policies will, in our sole discretion, vary depending on the severity of the breach and the user’s history on this app, including but not limited to, warnings, removal of problematic or infringing content or contributions, suspension or termination of use of the App or disabling user accounts. We may also notify law enforcement or issue legal proceedings against breaching users when we believe that there is a genuine risk to an individual or a threat to public safety. We exclude our liability for all action we may take in response to any user breach of these Terms of Use or our Legal Policies.

5. Complaints and Reporting Breaches of our Legal Policies

Please report any service, content or user contribution that you believe breaches these Terms of Use or our Legal Policies or infringes any third party intellectual property rights or has been mistakenly removed or blocked from the App. However, we will determine, in our sole discretion, whether a service, content or contribution is indeed in breach of these Terms of Use or our Legal Policies or infringes any third party intellectual property rights or has been mistakenly removed or blocked from the App. We may but are under no obligation to review or moderate the contributions made on the App and we expressly exclude our liability for any loss or damage resulting from any of our users’ breach of these Terms of Use or our Legal Policies.
